Filing a claim with the village?

my husband and i were on his motorcycle yesterday and we hit a huge pothole it was on a frontage road..the pothole went like a foot down. We both fell off the motorcycle and it looks totaled on the side we fell on. We were wearing protective gear so we didn't sustain anything major, we are just sore with internal burising. Should we file a claim with the village..do we have a reliable case. How do you file a claim?

  1. Before filing a claim...it might be  just better to send pics of this pothole and write your story to the village's administration along with an estimate of your damages. You may save lots of time and money .

  2. Potholes are, unfortunately, caused by nature.  People have been trying to sue cities for a long time, but you can only hope for success if you can prove the pothole has been there a long time, was reported a long time ago, and repair has been ignored for a long time

File with your insurance company.  That is what your insurance is for.  If the lawyers for your company think there is a case, they will sue.

  3. You can try and file a case against the city and take pictures of the hole that you hit and see what will happen, most all cities will be protected against this and I know that alot of people will disagree but many cities will do nothing.
