Filing an ACTUAL INNOCENCE off an DISMISSED CASE

in hopes of expunging the case all together? Can you tell me more about this? Anything? How likely is it to get accepted? Denied? Denied with or without prejudice?

  1. Your question makes no sense.  The phrase "filing an actual innocence" has no meaning.


  2. Factual, not actual.

    You file a petition with the court, showing how you are factually innocent.  For example, if your case was dismissed and then someone else was convicted of the crime.

    These are not easy to write up and not always granted.  See a lawyer.


  3. dismissed does NOT equal innocent.  It only means the DA or Judge felt there was not enough evidence to convict.

    Many people who have charges dismissed are very guilty.

    You have no chance to have you record changed to "innocent".

    Just like "Not Guilty" is not the same as innocent.  Just as OJ Simpson.
