Filing for BK in Kansas, hubby is not. He sells stuff on Ebay, will this be included in CMI?

Only I am filing BK, b/c debt is mostly in my name, hubby sells stuff on eBay and we have used some of his proceeds recently to pay down some of our debt, but now realize that we have too much and I am filing. Will his income from eBay be included in the calculation for the current monthly income? Usually CMI is calculated by taking average of prev 6 moths income. However, he may not be selling on eBay in the future, not sure. How would this affect either a chap 7 or 13? Not trying to be fraudulent, but past history is not a predictor of the future in this case. If in fact this info was not included in the BK and then in the future he started selling on eBay again, would this look like we were trying to defraud the system? Again, only I am filing, so how would/does his income come in to play in this instance.   1. Since you are the only one filing your income will be the only income that will be used.


  2. His credit is separate and he is not filing bk along with you, so he or his income is not affected.
