Fine Lines in FL Gun Control- ?

FL Section 790.25(5) says you can have a legal firearm for protection in your vehicle if "securely encased" or not ready for immediate use. Securely Encased is defined in Section 790.001(17) but immediate use is not and it seems vague to me. Would the magazine loaded but out qualify? What about not cocking the firearm with loaded mag? Even just the safety on?

  2. To put this into another view that might be easier, it basically means that if you are sitting in the driver's seat and you can reach a weapon and fire it without having to load it, you are in violation of law.

    What they are wanting to avoid is the possibilty of a citizen just reaching over, grabbing a weapon and start shooting.

    Keep the weapon cased. Have the mag loaded if you want, but do not have it near the weapon ( gun in glovebox and mag in the trunk).

  4. If the gun is within your immediate vicinity, ie, glove box, it cannot be loaded and ready for use as soon as you pull it out.

    The magazine and gun need to be separate. No mag in gun, bullet in chamber, weapon not cocked!

    If it is in your trunk, it can be loaded and ready for use, no problem there!

    I know, it is stupid and I have never been hassled about it, as long as you tell the officer BEFORE you reach for that registration in the glove box, I never had any issues.
