Firm has not made payroll in a month. Hwever they pd hlth ins for Aug & md HSA depsit. Shd I tel thm I got job

They never terminated us. I knew it was coming and got another job. Since owner wd not tell anyone I had to tell a guy going on vacation not to spend too much as he would not be paid. Since I have a job do I need to tell these guys I no longer am working for them. I did tell owner's son that I was getting another job if they did not make payroll. Do I need to remind him?

  1. The company may be trying to re-group. If they have not closed the doors, they may not be out of business. I believe the appropriate and professional thing to do is to officially quit in writing. Saying you are going to look for another job is not the same as getting/having a new job. In your written resignation I would state that they can mail your final check, including all back pay, to your address on file (or wherever you want it sent).


  2. You should always tell someone when you quit. As far as the HSA is concerned, they will work that out with the HSA administrator. They should send you a letter asking for any over deposits back. They can't take it back without your permission so don't spend it.
