Flatshare with an agency: who gets deposit back? ?

We rented a flat with my 2 flatmates, with an agency. Our 3 names is on the contract. I always paid the rent with my account. Now we're moving out, do I get the deposit back or can somone ask to get it back? One of the flatmates is rather dishonest and left the flat without paying his share of the bills.

  1. Phone the letting agency or the Landlord and ask how your deposit will be repaid.


  2. Unless it specifies in the tenancy agreement, the deposit will probably be paid back into your account.  I would suggest contacting the agency and asking what their policy is.

  3. Read the tenancy agreement.

    Go and speak to the agency, telling them the gist of your question.  Their main concern will be to get you to indemnify them if your former flatmate tries to get some or all of the deposit.  In fact, if I were you I would be round to the agent like a shot.
