Food Posisoning from Cheesecake Factory?

I had a really busy day and hadn't ate anything all day prior to dropping a friend off at the airport at about 830 pm. My parents insisted on meeting my husband and I for something quick to eat so that I could get something in my system before the 45 min drive back to my town, so we met at the Cheesecake factory.

We just ordered 3 appetizers and shared them, and we each got a piece of cheesecake for dessert. This food was the first time I'd had anything to eat in 24 hrs. Whilst sleeping, at about 4 in the morning I woke up feeling a bit queezy, but decided to 'sleep through it'. By 6 am I was throwing up every other minute, and the obvious effects of food poisoning set in thereafter. I called my parents to see if they could help me care for my 4 mo old son, only to hear that they were both as sick as I was. I went to the Dr., I have a diagnosis of food poisoning (i had to get my stomach pumped).

Do what the other person said to do; "Call the health dept." and also call your attorney, They know exactly what to do in cases like this. Of course the restaurant is going to deny everything. Don't accept the gift card because that will totally blow you case. You also have a doctors report. Sounds like a slam dunk for you. Let the attorney handle everything, don't even contact the restaurant again. Good-luck. Be patient because these things take time to settle but wait it out. The restaurant will end up giving you something eventually even if only to get rid of you.

Call the board of health and let them know. You could try to sue, but what will you really get? They did try to give you a gift card, which I wouldn't want either!

At least you went to the doctors and got a definate answer.

Throw out the leftovers. They definately aren't good.

You should not get food poisoning from a  restaurant. There is something wrong if that happens, and the board of health should be notified.
