For adoption, which county's court is used if the birth mother/adoptive family live in seperate counties?

Baby is born to birthmother in county 'A'. Adoptive-mother lives in county 'B' of the same state. Where does court take place?

  1. Could be either.  My adoption was handled in the county that the adoption agency was located in; which happened to be a county that neither I nor the adoptive parents lived in.

    It's a circuit, state issue, county doesn't really matter.


  2. The adoption is a completely separate legal case than any other the birth mother/child has been involved in, therefore can be in the county of your choice.  If CPS is handling the birth parents end, they may want it in the county that they are in.

  3. I tend to agree with Southern Girl's response.  My son was born in NJ, and we live in PA.  We had to finalize the adoption in NJ because that is where the birthfamily lived.  I would assume the same would hold true to counties.

  4. When adoptee's search for information regarding birth parents they need to request access to adoption records and the info that they contain and for them the records are held in the county of the adoptive parents.

Hi I adopted my son he was born in California and I live in Kansas, we went to court in Kansas, for the adoption, make sure you have papers signed by birth mother to take the baby across state lines to adopt, (have it notorized, with both bio/adopted there at the time of the notary), other wise they can get you for kidnapping if the mom changes her mind, Good luck They are a blessing, If your in the same state just call the courthouse where you live, and they will tell you everything you need to know. I'm sure you still do the adoption in you county you live in, not the biologicals.

  8. It is the county where the baby is born/ where the birth mother is.

  9. With an interstate adoption it takes place in the state where the birth mother is.  I would assume that it would work the same if the birth mother & adoptive parents live in different counties.  I'm not certain, but I would guess that County A would be where it would be.
