My son just got diagnosed with ADHD and Moderate Tourettes Syndrome. I am wondering if he can even qualify for disabilty, if so where do I go or call to get started in the process. We go back to doc here in 3 weeks, to determine if he has 2 more disorders. What kind of help can I get started with?

  1. I would check with the people from special ed at his school. They should be up to date on this

  2. Even if your child has a disability, it doesn't mean that they qualify for special education services. There must be educational relevance. If your son is doing poorly in school, take your doctor's diagnosis and go to the school counselor and ask for a child study to begin. This eventually leads to a referral for special education services, if the plans the child study team makes do not work.

Though states sometimes interpret special education law differently, these are federal mandates, so the same law is pretty much universally applied.

If you son has academic problems that can't be ameliorated by regular means, he can receive services under the Other Health Impaired category for Tourette's and ADHD. However, the testing may reveal a specific learning disability, so he could be categorized under SLD as well.

If your son does not qualify for special ed services, there is always Section 504 that allows for adaptations to tests and other classroom accommodations. This in and of itself is a lengthy discussion, so I suggest you go to the Wright's Law website to read more about your options.

  3. Are you wondering about education, or funding to help your son with his problem.  My son has several disabilities and I did not want to put him on SSI, but found out later that if I did not I could not afford the Doctors and medications that he needed to keep him going.   Just wondering what it is you need.      Thanks

  4. It's not just academic things that would qualify for special ed services, in fact, federal law states that IEP's are for children with quality of life issues as well, which is where the adhd and tourettes comes in.

As for SS disability, you'd have to contact the social security office and fill out an application. They'll ask you how much you make, quite often they'll say you don't qualify based on income. Or because the disability isn't severe enough. Go ahead and apply, they nearly always reject the first application for some reason, and apply again.
