Forced into army-public record?

Hi! My baby daddy was fired from his job @ a bank about a year and a half ago. He was caught embezelling money. Instead of being put in jail however, he mysteriously vanished into the army. My question is- if he was allowed to join the army in leiu of being punished, will this still be on a public record somewhere? I need some type of documentation showing what he had done/and-or actions taken thereafter. Any help would be WONERFUL! Thanks

Heather

  1. I don't know what you expect to get from this but it sounds like you feel he was forced into service unfairly. If he went into service as a plea arrangement to avoid a felony theft charge with possible jail time, then he was certainly aware of the agreement and signed onto it or he would be doing time in the prison system.

This might have been more common( plea agreements) in the 50's to early 70's but the Army and service in general does not want problem people in their ranks.

If his record was expunged upon entering the service, all you may have to go on is the date he enlisted and talking to Police in the town he was arrested or the business he was fired from.

Hate to say this but sounds like someone is not being totally honest with you and just took off. If you are trying to track him down for support and he did not change his name, the military should have a record of him but you may need an attorney to get this if you are not married to him.

  2. It was a very common occurance during Viet Nam to allow someone to enlist in leiu of going to jail/prison.

Although he may have mysteriously vanished from you, I am willing to bet he worked out some kind of deal to enlist as a form of sentence adjudication. No one just vanishes from sight and goes in the military. It was an agreement between all parties.

If you have the case number, you can check with the Clerk of Courts as to the disposition of the case that is on file. That is public record.

Other than that, you just need to wait and see if the ex contacts you.

Best of luck and I hope this is useful to you
