Found glass in a kellogg's product, can i sue them?

I bought a box of rice krispys, got hungry right after i bought it, opened the box and then took a bite out of it, i got through half of the bar and found a piece of glass in it. The piece of glass scratched my inner mouth. i quickly went to customer service, got a refund and the manager sent it away. i quickly went home and contacted kellogg's through phone n left a msg becuz i work during their hours of operation so i could never get ahold of them. they then asked me to send them a email. so i did explaining everything, they then sent a email back saying i would need to call them. i have the wrapper of that rice krispy, the box and the glass still for evidence. I also got a canker sore where there the scratch was (i get canker sores from biting myself and cuts) I was told to go to the doctor to prove and write something saying that was in fact from the glass. Kellogg's said they would send me 4 coupons for now n i can mail the glass in for them to inspect. I was told i should sue them becuz i would get more out of it. What are the chances of me winning with a lawyer? and what do u think i should do? should i still send the glass in or show a lawyer? is it all worth it?

  1. Awards are generally in approximately the amount needed to make you whole again.  So your doctor bill, and the cost of the cereal and maybe you would get a very small amount for the canker sore, maybe not since thats a problem you seem to have with them.

    A lawyer will take a percentage, even if he would take the case.

    I doubt its worth it.

    You know those great urban myths about getting millions? They are just that, myths.


  2. well, with court fees, which i have no idea about, and a bunch of other stuff, you can sue them. this mistake of theirs does not happen often at all. if you do decide to sue them, make a record of all communications with them. your phone calls, your emails between them and stuff like that. you pay the court fees after, depending on if you win or lose. Rememebr, bring as much evidence as possible. even the fact that they gave you the run-around. you could say that they tried to avoind the whole thing by doing that.

  3. You could call a lawyer and talk to them but they are expensive and it might cost you more in lawyers fees than you would win from a major corporation.

  4. Call a lawyer you may probably get more out of it than 4 coupon's's.  

  5. you would win for shure but sewing is evil and I like Kellogg's and I would hurt you or sew you  if you shut them down anyways just ask for like 20 coupons and you should be good. they would give you that many because they don`t want to go through the process of sewing well enjoy 20 boxes of Kellogg's cereal

Find a lawyer that will only get paid if you get paid because they will fight the hardest for you otherwise they don't get paid for their time, It's a Personal Injury attorney.  Don't give anything to anyone except your lawyer because he will keep it safe.  They usually meet with you to talk about your options and whether or not it would be a good case.

  7. Yeah.  Glass isn't supposed be in your cereal.
