He lived in california for 3 years straight with a visitors visa. 7 years ago he was deported because he was not allowed to live and go to school in the US with a visitors visa but his visa was not expired though. He was 12 years old when this happened. His grandmother and 2 uncles from his father side have greencards, his father is also living in the US with a visitors visa but he did not get deported because his youngest son (my friends brother) was born in california. He would have to wait 10 years to apply for a visa from the date of his departure. What are the chances of him getting another visa? Are there any visas that would be easier for him to get? Thank you all for your help and time!

  1. Slim to none!

    he made a big mistake

My only solution is, one of ur  ur family member trying to get an American  passport and filling for him on a waiver( explaining why he overstayed his visit) status and hopefully he might get in to america again.   WORTH TRYING!!

  2. Well, considering he lived illegally in the US and was actually deported, it would take a lot to convince an interviewing visa officer that he now has strong ties back home and would actually come back on a tourist visa. Plus he has lots of family here as well. As for other visas, what other sorts of visas might he be qualified for? Hard to say, since we don't know anything about him. While his brother could file an immigrant visa petition for him at some point, the brother would have to be 21 first, and then it would take at least 11 years before that petition would be valid. So, unless he acquires an American wife, he'll have to wait for the 10 years to be up before he'll be able to come back, if he can qualify for something other than a tourist visa.
