Friend hit my car and has no insurance?

My friend hit my Audi wagon with her truck yesterday. I have insurance but she doesn't. In fact I found out she actually has a suspended license. She has zero money and I don't know what to do. If I report the accident then she WILL get in trouble. But I have to get my car fixed - it hasn't sounded right (not to mention what it looks like now) since the impact. She said she could give me $500 to cover my deductible. But how am I supposed to report this to my insurance???? I don't know what to do. help please.

  1. By law you need to inform your insurance company even if you do not intend to claim from them.  If you do this and you give your friends name then as they don't have insurance the insurance company will claim the money directly from them.

    There's no easy way to say it plus if the insurance company get involved it could ruin the relationship between you to.  It's probably best to sort it out between you.

You should report it to your insurance company if you want to get your car fixed.  They will charge you the deductible and then go after your friend.  If they collect from her, your deductible will be returned.  And before you ask....No, you cannot tell your insurance co. not to go after your friend.  They will be paying out to have your car fixed and they will want their money back.  Maybe she will now be responsible and buy some insurance

  3. Well you have no choice except to report it to your insurance-  they aren't the police- they wont get your friend "in trouble"

    HOWEVER- once they pay your damages minus your deductible- they will go after her to recover ALL the money associated with this loss.  That is their legal right- she was at fault- she must pay for the damages.

    She can likely set up a payment plan with them to pay for it over time.  But you know what- she deserves i hope she learned a lesson this could have been way worse.

  4. Report the accident to your insurance company. If she is anything of a friend she will understand you need to get your vehicle repaired.

    Your insurance company will cover the repairs less your deductible. She will then be required to pay your insurance company back.
