g*y couples and american visas for fiance/spouse?

Now that g*y marriages are legally allowed in some parts of the united states, can g*y couples use the k-1 visa (fiance visa) or the one to bring your spouse into the country if the marriage is same s*x?

If you have any links or anything that would be great. Also, I know that before it wasn't allowed, however I'm wondering if that's changed now.

  1. No, it has not changed.  It is still not allowed.


  2. No, DOMA forbids the federal government from recognizing a g*y relationship as equal to a marriage. It doesn't matter where it might be legal.

    There is a bill going through congress supporting a change in the law to rectify this.

    While individual states have the authority to permit same-s*x marriage within their state borders, immigration law falls under federal law; therefore, until federal law recognizes same-s*x marriage, immigration law will not permit same-s*x partners to apply for spousal visas.

  4. g*y marriage is allowed in CA. it is not a federal issue. you can't have a same-s*x spouse application.

    please be aware that if prop. 8 passes in November, there won't be g*y marriage in CA either.

  5. No. The USCIS does NOT recognize same s*x marriages.
