General query for passports rules?

Question

My elder brother got his passport issued from a place (in India) where he never went.My father helped him in doing so with the help of my other relatives.My other cousins resides there and my brother name got included in the ration card also.It was very urgent as he had to go to Germany very urgently.he is abroad now.can he be prosecuted for this?we are worried pleas help us

Is he not entitled to have an Indian passport?  Did he commit some kind of fraud?  Last time I renewed my passport, I did it completely through mail so I never went to the place either, it's still a legal passport.
