Question:

Getting Payment Options in writing?

I got a Warrant of Debt, and called Capital One to see what my options are. I have a few options...pay half now before the court date which would automatically get me a continuance until the next month, and then pay the other half before that date, and no judgement will be filed; or pay $900 by the court date, or a payment plan but they would still pursue a judgement.

Anyway, I want those options sent to me in writing...basically, I plan on paying the half and half thing. But I want in writing that as long as I do so they won't pursue a judgement. I asked them, and they said no. Are they allowed to say no when I ask for an agreement to be sent to me in writing? It makes me nervous.

  1. There is no law that states they have to put arrangments in writing, this would just be a courtesy.
