Getting a green card after Visa expired?

I have an acquaintance whose student visa expired. Is there any way for him to get a green card, or is it a lost cause at this point?

  1. Student visas are issued on the condition that students return to their own country upon completion or termination of studies.  Student visas can never be converted to any immigration-class visa.  And now that the person has overstayed the student visa, he is a deportable illegal alien and will be barred from re-entry for a period of time.  The length of the ban depends on how long the overstay.  The only alternative is return to his home country immediately.  If he's deported, he gets a longer ban.


  2. Hopefully not. He should not have overstayed his Visa.

  3. An F1 is a non-immigrant visa and the student agreed to leave when it expired. The longer he remains the harder it will be to ever come back.

    He can't get a green card since he violated his F1.
