Getting back to Mexico?

my boyfriend is illegal and wants to go back to mexico to come here the right way. would there be a problem at the border? or will he have to sneak back into Mexico? what will he have to do to get back to Mexico? detailed answers would be great =]

  1. If your boyfriend has been present in the us for more than 180 days he is facing a 3 year ban. more than 1 year and he is facing a 10 year ban. That ban goes into effect once he crosses that border. His only chance at entering legally will be with an approved family petition I-130 and an approved I-601 waiver to overcome prior illegal presence. the i--601 waiver is only abailable to family members, i.e. fiancee, wife, parent, or sibling United States Citizen. Please understand that without a USC family member to file that I-601 for him he will not acquire a visa legally. There are waivers avaialble for work visa but they are extrememly hard to have approved since work visa are suppose to be non-immigrant and his illegal entry and stay shows he has immigrant intent. As for your question he is a citizen of Mexico and can cross back into his country whenever he chooses. Just be aware that without a family member to sponsor his I-130 and the waiver he won't be coming back legally.   3. If you are thinking of sneaking back and then applying as if he was never in the US illegally you might get past the border. After that the US will investigate where you boyfriend has been. If he stated that he was not illegally in the US and they find out he was, he stays in Mexico. Visa fraud is a no no!

    The US WILL investigate and if he was here for any length of time will most likely find out!

  6. soorry but if he is illegal he cant come back in. unless he has a visa. my bf is illegal to and we spoke to a lawyer and he said unless he never been here in the usa before and we would get married in mexico we could change his legal status and it will take from 6 to 12 months. i hope these helps!

I would not try to lie to the immigration department.  Please think about it your boyfriend probably took some sort of picture or got an id or something that can say that he was here and then he will be in deeper than he already is.  The only way to fix his problem is to apply for the I-130 and then after it gets approved go back to Mexico through the normal border and ask for a pardon for being in the US illegally at the consulate (that will take about 6 months or so).  The only way he will be able to come back legally (if he is granted the pardon) is if you are his wife and a US citizen and you petition for him on the I-130.  Good Luck!

  9. Not sure where you are, but the one time I went to Mexico I walked through. Went through a revolving gate, and no one asked anything. There were no Mexican officials looking for a passport or paperwork. You are leaving the US so of course the US personnel didn't care.
