Getting deposit back? 3 weeks late?

I live with my mum and we lived in a rented flat until 3 weeks ago. We had nothing but trouble with the estate agents. They were never helpful and as soon as my mum gave the month notice in the were coming round with new people to look. Giving no more than an hour notice the even tried to say they would let themselves in even though they were told twice that this wasnt necessary if they made a proper booking. In the end my mum said she didnt want anyone to come round until the tenancy was over. We moved out of there 3 weeks ago last friday and my mum still hasnt received her deposit back. Shes been in and they told her they will send it by post. What else can she do?

  1. well, it is at the discretion of the landlord. The judge will look for a reasonable amount of time.

    Reasonable can be: amount of time the landlord judge necessary to be sure that the money is being due to the authority: council tax, benefits...

    Conclusion: deposit is usually return within a month, but can be much longer according to the tenant AND landlord

  2. If you rented the property before, April 07, the deposit would not have been protected, so its the agent you need to get to.

    Your mum should write to the agent stating that she expects her deposit back with in 7 days or she will be taking legal action, as they have been holding the deposit for 3 weeks, with no reason.

    This must be sent in writing, and hopefully it will make them reply.

Go check the local laws on how quickly you get that back.  Where I am in the USA the landlord has 45 days to return the deposit or send a list of costs to which the deposit went (so 3 weeks may be jumping the gun).  Anyhow, it sounds like the landlord is still planning to send back her money so I'd just keep calling and bugging him.  If its gets to a point where he starts ignoring you or just won't send the money, and the deadline to get it back is past - then you may have to take him to court for the money, but its still very premature for this.  For now, just keep bugging him and find out exactly how long he has to do this.

Hang on ... in the UK it is no longer legal for a landlord or lettings agency to hold the deposit themselves.  They must pay it into a deposit protection scheme - this is a scheme that has been set up mainly to benefit tenants, to prevent landlords from withholding it without just cause, and also to ensure that the money is protected should the landlord or lettings agent go broke.

    What happens is that upon termination of the tenancy - i.e. when you move out, not when you give notice - the agency should instruct the deposit protection scheme to return your deposit to you.  So, the deposit protection scheme people will post you a letter confirming how much you're getting back and will ask for your bank details so that they can pay it directly into your bank.

    My understanding is that it is typically taking about a month to get it back.  But, one thing I would check is where the deposit protection scheme have posted the letter to.  Usually they post it to the house that the deposit is for, which is the dumbest thing ever because of course you no longer live there and that's why you're getting the deposit back.  Are you getting your mail redirected by the post office?  If yes you should still receive it, but if not then you'll need to track down where it has gone.
