Getting married.My Boyfriends visa is expired.Need Help?

My Boyfriend is a professional boxer.He's from Nicaragua.He was granted a visa to come here in 2006 obviously overstood his visa which was good for i think about 6 months.Well I'm not pregnant and want to get married to him.If we go get married in las vegas Will be be able to file for his papers here in california to work and get a social security number.It's really important that he can get working papers for here in california.Also we would need permission for him to be able to leave to puerto rico,england, etc?HOw is this going to work.

  1. You need to petition for him to become a legal permanent resident by means of your marriage.  (USCIS Form I-130).  It will take time to process, and it is possible that he MIGHT be able to get a different type of visa in the meantime for travel purposes, but I would consult with an attorney on that one.


  2. He violated the law, most likely he will be sent back even if you marry him.

    Then he'll have to try and get another visa, but they will check to see if he is trustworthy.

    Well as you pointed out he violated his stay after 6 months for 2 years, most likely they will decline in giving him another one.

    So now lets think about you.

    Do you really want to be married to a man who you'll never get to see unless you go to his country or another?

  3. Since he entered legally but overstayed, he might have to file I-601 and get an approval to get overstay waived. Once you get married, you need to file I-130, and he needs to file I-485, I-131 and I-765 along with I-864 and possibly I-601. He alos needs to include medical exam results. You, as US Citizen, need to prove that you are making above the federal poverty line. You may want to consult with an immigration attorney.

  4. He is now illegally in this country and needs to go back to his own country.  You are free to join him there, but do it the legal way.

  5. If your a citizen he will become a citizen once your married. All he has to do is re apply for a new visa and continue through that process.
