Getting married to underage in order to give her papers....?

my son is 19 (american citizen) and his girlfriend is 16 and had some immigration problems. she was forced to leave the country (she was not deported but had to voluntarily leave with her family).

He wants to bring her back and the only way seems by marrying her. Being that she is 16 would she be elegible to get the greencard as long as she is married to a citizen? or does she have to be 18?

  1. Maybe your son can go see an attorney about this. If her parents give her permission to marry then it could be done.  Try getting her a fiance visa.  But I would definitely seek professional help, at least your son should.


  2. I think it would be wise to marry for love. But if it's what he really wants, I think she has to be 18. At least, that is the legal age and he wouldn't go to jail. Besides, I think 2 years would give him time to determine if he really cares for her.

    What parent woudl condone a 19 yr old to marry someone underage?

    And illegal!  

  5. As a mother, I would try to make my son forget about this girl, because it is such a long and stressful process, with no guarantees she will need to have a waiver to be able to come back. And , also you will certainly need a good lawyer ( $$$ ), because it is not just about saying he wants her back.

    And, again, you are not just dealing with an age problema, her immigration issue, is much more complicated than you are expecting.

    He is young and will get over it. Believe me.
