  1. Go and get it back

There is no proof that you were drunk.

    Learn from this though.

  2. for driving drunk yea. w/o a license yea. but at least you were reasponsible enough to get off and leave.

  3. no, they cant really prove you were drunk X number of days ago, if anyone called in say that you were tired or you just woke up or even that you were lethargic due to taking night time tylenol for a head ache.  if the guy had a picture of you w/ a beer say it was soda.

  4. No, not unless you are drunk when you pick it up.  Unfortunately, some drunk drivers leave the scene of the accident with their vehicle all smashed up and then make themselves scarce so they have time to sober up.  When the cops catch up to them, they are only charged with leaving the scene of an accident rather than DUI.  Chances are the police do not have your bike, though. Disregarding the underage drinking issue, I think it is stupid overkill to cite people for riding a bike drunk. No operator's license or insurance is required, so how are they going to enforce it?

Edit: They have to prove you were drunk at the time.  Someone calling in would not do it, because it would be his word against yours.  You could tell them you were tired, for example, not drunk.  If the witness got a photo of you tooling down the street with a beer in your hand, you are sunk.  But if not, you have nothing to worry about except being out a bike.
