Getting someone out of your home...Australian Law question please help.?

I'm hoping someone with a legal back ground may be able to help me.

My mum has been asking her ex-partner to leave her and her home for the past 3 years but she will not budge. At one stage my mum offered her $50,000 to help set her up in a new place plus to take whatever she wanted from my mums home, but to no avail. It has now gotten to the stage where my mum is utterly miserable and wants this other woman out of her life so she can get her old life back. The house and car are both in my mum's name.

If anyone can be tell me what legal rights my mum has to remove this woman from her home I would really appreciate it.

  1. Just call the police to throw her out, if anything not allow, police will tell you.


  2. If this other person isn't on the deed or the lease, your Mum would have the right to ask her to leave. Go to the local police station and ask for some advice/help from them.
