Getting sued because i burned some1 ?

Im getting sued because i burned some1 at work (employee) not on purpose! but their parents think i did it on purpose... whats the worse i can get? can i go to jail|? or wouldi have to pay for the medical things, or would i go on probation ? wat would happen

  1. If they can prove you burnt him on purpose, you might go to jail. But being first time, just fine and pd maybe.


  2. If it happened on the job and it was another employee that was injured - they should pursue a workers compensation claim rather than you.

    If they decide to actually file a law suit - it would be incredibly stupid to sue you -- if you don't own a pot to p in - they can get a judgment and never get a dime. The idea is to go after the deep pocket -- your employer.

    If it happened on the job your employer should hire an attorney to defend you.

    Also - notify your homeowners insurance or renters insurance about it. There is a good chance they will not have coverage - but throw it up - it might stick. Talk to your insurance agent about it. If you do decide to file a claim - file it before the law suit gets filed so they can investigate it.

    If you get sued and do not answer the suit with in the time limit - you get a default judgment against you. That's an automatic you lose -- you will not be able to argue any negligence on the other person or any other defense.

    Since you are not a lawyer -- I would not recommend that you make assumptions about what will happen. Rather consult an attorney and get a legal opinion form a person with the qualifications to give it.  But before you do that -- speak to management at your employer. They have a dog in this fight and they have the deep pocket.

  4. Talk to your employer, I'm sure they have insurance for this sort of thing.  It happened while your were legally employed and by law they should have coverage for this sort of thing.  While at work your employer has legal responsibilies for all its employees and accidents while you are there.

    You didn't say what state you're in.  A lot of states have websites showing state labor laws, particularly in regards to employment.  If you have a union, they should be able to give you advice.  

  5. If you didn't do it on purpose, then it was an accident.  People don't go to jail for accident (other than like drunk driving).

    At most you would be paying for medical.

    P.S.  get a lawyer.  Sadly it is safetr to pay for a lawyer than just to pay the same to the other person - because there's a chance you can get clobbered without a lawyer.
