Girl bumped my car and hasn't paid?

I was involved in a car accident in October 2007, where a lady bumped into my car from behind. I sent her quotations, for her to submit to her insurance company; which I hope she did.

My car suffered damages and her insurance never contacted me and every time I call her to find out about my car she tells me she’ll contact her insurance to find out why and then doesn’t get back to me.

I have since fixed my car with my own money and feel that she is accountable for damages and should pay me back.

It's now August 2008, I cannot afford a lawyer or an expensive one. How do I go about this?

  1. a small claims court in not that expensive and you could call her insurance company.  you should of called your insurance company and they would of delt with her insurance for you.  save your recipts and any proof. document everything!!!

  3. Your insurance company should be getting you the funds, they should take care of getting the funds from her ins company.

  4. She isn't contacting her insurance because her rates will go up.. you should have contacted your insurance co and had them contact hers...

    She should have given you her info... contact her insurance yourself..

    after that, the only thing left is small claims court....

    she will continue to put you off, until you give up and go away.....

  5. You should have contacted her ins. co. first. Now that the car is fixed I believe you're toast.

  6. your insurance company was called right  and the cops wrote you a report should be all you need... you shouldnt have had to do anything  is why you have insurance and now you have to prove it in court  

  7. I hope you got a police report.  If you did take her to small claims court.  if not you could try, but it may not work out that well.

  8. Do you have all of her information?  if so, you should contact the police. File a report, that way if you do have to take her to small claims, there is a record on file of you attempting to get your money.

    if you have her insurance information, contact them directly, that should have been dealt with immediately, NOT a year later..(hindsight is always 20-20)

    When you get involved in an accident, take the other drivers insurance information, and never admit guilt (in her case it was a rear ender, so, no question it was her fault)

  9. This is one of the reasons why you have insurance in the first place.  Contact your own insurance company and get them to do the work.  That's what you pay for.

    But to be honest i fear that you may be too late to issue a claim. usually you have to have things started within 30 days of the even.
