I am in the process of getting divorce. We have a house together. My question is should I settle now and give her the half that corresponds to her, or should I put in the settlement to wait up to two years. I can see benefits with both approachs... In the first option I would just be done with it (no kids). While on the second option I can keep that money for two years and earn interest. What do you think??? We are talking about 57K.

  1. Give her the money now. end the relationship and all ties once and for all. you do not need this hanging over you. by hanging onto the money it puts your life and hers on hold and it comes across as being nasty towards her.

  2. Does she have an opinion in this matter?  If she does, I think she would want the money now, so that she could earn interest too.

  3. DUh?  Interest on 57K over two years....think about it.  Let her wait.

Is her half based on today's value (with you securing the accrued interest over two years), or will she get the half of the value with accrued inrterest?  If the latter it's 6 of one, half dozen of the other.  If former, let her wait.

  4. just get it over with .

  5. get it over with now..why suffer...

  6. personally, i would setlle up now.  that interest would be nice, but she might also try to claim the interest.  what you have to ask yourself is...what is your freedom worth to you?  it's better to not have a 57K elephant hanging over you, as you never know what will happen in the next two years.

  7. settle and be done with it - it will give you a clean slate to move on with your life... based on savings account/term deposit interest rates, you would only make around $6000-8000 in interest - i would say you would spend more on legal fees if you drag it out 2 years?? just settle

  8. why? just do it now and get on with your life and let her get on with her life.

  9. "should I put in the settlement to wait up to two years"

If you live in the US...  You can ask for whatever you want, but that doesn't mean she has to agree to it.  And if she wants her half now, the court will rule in her favor, unless you simply don't have the money (it appears that you do have it) and need time to acquire it, and even then they're not going to give you two years.
