Given a 3 day notice landlord shows up?

I was given a 3 day notice to buy or move out. my notice expired today(7/25) but they are giving me until Mon(7/28) I explained to them that my new place will not be ready until 8/1/08. My landlord told me rent a storage and move into your vehicle until then...just be out by Mon 8 am. What do I do if my landlord shows up Monday and demands I leave? Or what if she tries to lock me out? I will be out by 8/1/08 (long before they can take me to court over anything) I am nervous about leaving my house alone while I go to work. Can someone give me advice?

  1. Okay first off a three day notice is the preamble they  must serve before filing for a 30 day notice of eveiction. If he shows up on monday there is really nothing he can do to get you out. He has to go to court and file a 30 day notice. The sheriff then would have to come to make you leave not the landlord.  Tell the landlord you know your rights and if they want to save the money of filing a useless eviction to wait until august first. Also, pay them the money you owe them as soon as possible the landlord can take you to small claims court to collect unpaid rent as well as fees. Even try to work out a payment plan (in writing and collect recipts) to avoid court.


  2. Don't be surprised if you come home Monday and find all your stuff out on the curb.  A 3 day pay or quit notice is quite common when you do not pay your rent.  It may take longer to legally evict you, but if you do get locked out, you would have take the landlord to court to do anything about it.

    So either pay your rent or be prepared for the worst.

  3. I don't know of any state where a 3-day notice is legal and upheld.

    If he/she shows up, tell her to call the police, or volunteer to do so yourself. They cant make you leave with only 3 days notice. No common person could find a new home in 3 days, so it's illegal for her to make you leave in 3 days.

    If you do come home and the locks have been changed, call the police. She/he cant enter unless they have permission from you or have notified you ahead of time. I'd put important things in a lock box, like birth certificates, social security cards, etc... in case they do go a little Magoo and clear your stuff out.

    Regardless, it's illegal.

  4. unless you signed a agreement that states you are willing to move at a moments notice,your landlord is pulling your chain

    if you chose to be a ****. you could make there life a living h**l.I own 5 rentals. you as a rentor have a ton of right.simply call your local department of housing and ask what rules and regs apply to your area. you my be suprised what you can do I know i was.
