Question:

Giving parental rights to my parents if i die?

I am wanting to make sure my parents get my daughter if I get killed or die. I dont know what forms I need to fill out in order for this to happen, anyone have any suggestions on what to do or what forms? I am getting ready to take fathers parental rights away, and she will become a b*****d with just me as a parent. He hasnt had anything to do with her since the day she was born. thank ya

  1. You need to see a lawyer and have a legal guardianship document drawn up that you sign.  Its the only way to legally assure 100% that your child goes to who you want in the event of your death.

  3. This should be written into your will.  If you don't yet have a will, you should get one done.  It's the best and most certain way to make sure your estate goes to the people you want to have it and to be sure of who will get your child if you die or are unable to care for her.

  4. You need to have a will that states that and I would also suggest your parents (God forbid) should pass before she is old enough to live on her own.

  5. You will need to make sure to have the information added to your will and give your parents a copy of that Will or let them know where to find your will in case something should happen to you.  Put down that it is your wishes that they take custody if you should die before your children are adults. Make sure you choose another person as well though as a "backup" person because something may happen down the road and they may not be able to care for her so you will want someone else other wise the courts will just have the whole decision.  The courts will usually got with a parents wishes as long as they find it is in the best interest of the child.  

    My exhusbands exgirlfriend did that with her two kids...she left them to her mom if she should die.  The courts took that very serious and in the end she ended actually adopting the kids after their mom died.

  6. Contact an attorney who specializes in estate planning and family law ASAP.  He/she will be able to write up everything you'll need and advise you on all legal ramifications thereof.

  7. if he is a stranger to her, than he does not automatically get rights to her. My kids also have just me. He has not signed away his rights, but he has not exercised them... so I don't worry about that. I just made a will saying which family member was to get my kids
