Question about work visa??

I am American my husband British. He came over here on a fiance visa. We were married and then applyed for the adjustment of status. His work visa was only good for a year. He applyed for it again, but they are taking longer than they said so now his work visa has expired. His work is letting him work can they do that? Could he get in trouble? we're just waiting for him to have his biometrics then they will send the visa but until then he is working on an expired visa.

he's not over here only on a work visa he's over here on a fiance visa and pending I-485, you get the work visa when you apply for adjustment of status

  1. It's his employer's problem, not his.  Some employers track the dates closely and some don't.  The employer should suspend him from work until he either gets a green card or a new work permit.  It's not your husband's job to tell his employer how to run the company.


  2. Unfortunately, employers has the right to let him go because he has no working permit at this time.They will be violating immigration laws if they will retain him.It is advisable to file renewal of working permit 3 months before it expires to avoid delays.
