Got caught driving with a bac on .05 or more; Can I get out of it by questioning jurisdiction?

Is there anything i can do to get out of this??

I was pulled over by a brea cop who saw me speeding into la habra. im under 21 so a bac of .05 or more gets me a ticket. i was pulled over on the intersection of Lambert and Palm, however the location on the ticket says Lambert and Berry (about a mile away). Also, the Officer made me blow twice and both times didnt tell me my bac. i still do not know what my bac was. the forms i was given say that i can apply for a hearing to contest the suspension of my license.

Anything i can do?

  1. Yeah. Stop driving. I go through that neighborhood sometimes and I don't want you running in to me! Hope they pull your license.


  2. no you cant really get out of it cause a .05 can still be considered under the influence

  3. Nope.  Lambert and Berry is where he first saw you...where you were speeding.  Basically you cannot have one drink and drive.  Where I live if you are under 21 and you have any BAC you'll lose your license.

  4. If the breath test was administered on scene, he is under no obligation to tell you the result. That test is a screening device only, and probably will not even be admitted into evidence.

    As far as the location, that will not make a difference. Driving with a .05 BAC at Lambert and Palm carries the same penalty as driving at Lambert and Berry. If you challenge the location, the court will probably just amend the ticket.

    Actually, a MEASURABLE BAC is a violation if you are under 21.

    Claiming the citation shows the wrong LOCATION is not the same as questioning JURISDICTION.
