Got hit while at rest in the stop sign, who's fault?

I got an accident while I am at REST in a 4-way stop, heading west.

Suddenly another car heading south which supposes to make a left turn got out of control of his steer and jump into my lane and crash my car!

Is THAT driver supposed to be at 100% fault? I am still at rest before the stop sign at that time.

That driver reported to the police that he was picking up something from the floor while turning, so he got out of control of his steer.

  1. Absolutely his fault. You were stopped legally, where you ought to have been, and he crossed over onto your side of the road, and hit you. You're in the clear.


  2. As long as you were stopped and had not yet entered the intersection the fault is entirely his.
