I was a passenger in a accident but it wasnt our fault...I got neck and back injury...we also got a attorney...

do we get money from the accident. My cousin said got money from his accident . and how long does it take to get it. I dont know how this goes...Im 19 year old.

  1. Why aren't you asking your attorney this question?

    Anyway, just because you may have been injured does not necessarily entitle you to monetary compensation.  The threshold requirements do vary from state to state.  Some are verbal, some are monetary and others you must sustain a serious injury.  The definition of serious also varies.  

    Assuming you are tort eligible, once you have stopped treating the claims adjuster will evaluate your claim based on the nature and extent of your injury, treatment, disability and permanency, if any.   If you do not have PIP coverage available to you, then your medicals and lost wages will be included.  Your attorney will take his 33% fee.  If you have unrealistic expectations, then the case will never settle without recourse to litigation.  The litigation process can take years.  There is no set timeframe for resolution.

  3. The person who was driving the other vehicle should have liability on their vehicle. This coverage will cover you and anyone in your vehicle should you be injured. So depending on their limits... you may be covered. You will need to contact their insurance company to make sure.

    Also in some states insurance companies make it mandatory to purchase "Personal Injury Protection" or "No-Fault Insurance". This means that no matter who is at fault in the accident.. your insurance company will pay for part of your medical bills depending on your limits. Some states don't require this coverage... so I don't know if it applies to you.

    But bottom line is... you should be covered to go to the doctor for your back and neck.

  4. There are many things to consider here.

    But First of all, you do NOT just "get money" because  you were in an accident and have an attorney.

    Secondly, What state did this happen in? If the state is No Fault, you will have to file a PIP (personal injury protection) claim w/ the carrier for the vehicle you were in. Then, your medical bills have to meet the threshold for you to even attempt to collect any "pain and suffering" from the adverse carrier.

    Thirdly, it will also depend on the comparative negligence laws of the state the accident occured in.

    Fourthly, other things to consider are, what coverages are even available to you, the extent of your injuries and type of treatment you receive.

    If you hired an attorney, maybe ask him your questions, since after all, he will be taking AT LEAST 33% of anything you may collect from the claim.

  5. There are few "threshold" to cross for you to get MONEY for pain and suffering (over the medical bills).

    You must have at least one of the following:

    (1) broke bones

    (2) loss of life

    (3) loss of limb

    (4) loss of bodily function

    (5) loss of work time (3 months out of first 6 months).

    Otherwise you only get your medical bills paid off.

  6. No apparently you will have a difficult time getting any $ - I have been awaiting paperwork for 6 weeks now - once we agreed upon a price for my car.

    apparently this is standard practice for auto insurances - I have spent thousands on my accident (3 to be exact) and haven't saw a dime yet - I am beginning to think I'll never see another dime -
