Question:

Got into a fender bender,what should i do?

I HIT THIS FAMILY VAN IN HIS REAR FENDER (MINOR THOUGH) BECAUSE HE WAS AVOIDING A VEHICLE THAT VEERED IN FRONT OF HIM WHILE WE WERE CROSSING AN INTERSECTION WHEN THE LIGHTS TURNED GREEN.I ASKED HIM WHAT SHOULD WE DO ABOUT THE DAMAGES AND HE TOLD ME THAT LETS JUST TAKE CARE OF OUR OWN DAMAGES THAN CLAIMING IT WITH OUR INSURANCES...SO THEN I AGREED AND WE LEFT THE SCENE.HOW SHOULD I DEAL WITH SUCH INCIDENT?DID I MISS SOMETHING?WHAT ARE THE PROS AND CONS OF MY ACTION?

  1. you could be leaving yourself open for all kinds of trouble, you never ever have any accident minor or otherwise without calling the police, you want them there to witness both sides of it, so neither party can claim a day or two later that they were hurt real bad or their vehicle had major damage, they will take statements and pictures and you have a witness if you ever need one, you are always supposed to trade information, insurance carriers, phone, addresses etc etc.........plus if anything was said later, you or them could also get a ticket for leaving the scene, if you did get any damages you have no way to get the money for it now, because now it is your word against his, good luck though and have a great day, ps, some damages are not visible by just looking at the car either and wont be found till a mechanic gets digging around in there, that is why insurance claims have a open end so that if more is found it can be added to the estimate, hope that didnt happen to you

Never, ever try to settle on your own.  Settling on your own very often comes back to haunt you.  More damage was discovered later, "my back hurts", etc.  Always, always call the police and always, always, notify your insurance company.  Call your insurance company now and let them handle it.  That is what you have insurance protection for, let them protect you.

  3. he prob didnt wanna go through insurance because his damage was minor and if you just pay for his damage h**l get it fixed alot quicker.

    it depends how bad your damage was and if its gonna cost you less to fix than your excess is, which i doubt it

  4. The other driver might not have had insurance. Pay to get your vehicle repaired. Your only alternative is to tell your Insurance Company a lie. And that should not even be considered. Did you exchange any information at all? I hope not in this situation. If you did, wait a few weeks before repairing your vehicle, in case the other driver contacts your Insurance Company. If he does, turn in a claim. This is a good example of why you should always exchange information ( name of Insurance Company, name & phone # of Insurance Agent, Insurance Policy #, drivers license #, license plate # of vehicle). Evin if the other driver doesn't want to turn in a claim in. Evin if the other driver doesn't have Insurance. Get a police report. In your situation, you would have the information for future reference.

  5. The best scenario is that you never hear from nor see this person again. (kinda a pro)

    The worst is that he /she claims injuries from this accident.  (con)

  6. Usually, people exchange info and call police to get a police report number and call your respective insurance and they determine who's fault it is.

    Since he didn't want to go through the insurance and you agreed, there's nothing you can do now.
