was my fault"in the police report the cop marked that i was rear ended and i remember when the driver told me "im sorry i did not see you"

i went to get my car repair estimate and was over 4000 and i also went to the emergency room 3 times for complications (first time like 10 hours after the accident for whiplash) next two times for pleurisy ( seat belt impacted my chest and my lungs tissue got very inflamed and i could breathe right) i've been calling the trucking insurance (its been almost a month) but they keep saying to call back and i cant never get ahold of them. should i report it to my car insurance and wait for them to go after the trucking insurance after fixing and paying my car and hospital bills? but my payments will go up. will they also pay for my pain and suffering ( it was a week of h**l rushing to the er barely breathing) plus all the crying of frustration with these trucking people. or should i get a lawyer ?

  1. my first question to you is, why are you doing all the chasing around? Your insurance co should be doing all of that for you. If they won't, then get a lawyer and tell him or her what is going on. They should be doing everything for you, thats why you pay them money for protection. Go to the police and get a copy of the report and keep it for yourself. Sometimes they can't seem to find them when you need them. Good luck.


  2. I WOULD TALK TO A LAWYER, ITS FREE TO CONSULT AND GO FROM THEIR.  I HOPE YOU HAVEN'T GIVEN HIS INSURANCE COMPANY A RECORDED STATEMENT.  THE INSURANCE COMPANIES LAWYERS ARE VERY GOOD AT TWISTING YOUR STATEMENTS AROUND.

You should have reported it to your insurance company as soon as it happened.  The reason the other company is stalling you could very well be they know you are an amateur and have not notified your own company.  You paid good money to Your insurance company for protection, now allow them to protect you.  Call them  N O W  !  PS... being rear ended is almost always the rear enders fault and don't worry what anyone SAYS as to who is at fault.  The police and insurance companies determine fault.  As long as you are insured, the last thing you need to worry about is FAULT.

  5. Depending on whether you are in a no fault state. I could call the insurance company and see if it would reflect on your rates because it would be a pay out. Did you have an insurance adjuster look at your car? You could get a lawyer on a contingency basis, but he would take 1/3 of any settlement. Since you have other issues outside of just car damage, it would probably be best to hire an attorney. Maybe you can work out the payment before hand. Make sure you keep all insurance related information. Also, you may want to contact your health insurance carrier to tell them what happened, as they may want to recover their money from the trucker's insurance company. Sorry you were hurt and victimized by their insurance carrier. I hope you feel better soon.

Don't settle for nothing and move on, get a lawyer, he rear ended you, even said "im sorry i did not see you", its his fault. Sounds like the trucking company is trynna pull a fast one and hold out till you forget about it or nothing can be done anymore. You have suffered enough and been to the hospital many times, get your money, call a lawyer as SOON as you can.

  7. I have State Farm and they are really good about contacting other insurance companies for claims. Doesn't cost you anything. Contact your company first before getting an attorney.

  8. it should be his fault for hitting you in the rear, because the law says, you have to have your vehicle under control at all times. at least thats the way it is here in pa.
