ok so heres the deal my fiance's kid is almost two years old his mother died of a drug overdose on june 4 of this year. I have been taking care of the kid with my fiance everyday since then and even before then. The grandparent Sue wants to try to fight for rights on his kid. What rights does she have. She watched her daughter overdose in a hotel room and did nothing about it until the next day. This is not something he wants his kid around. Also we plan on getting married soon (we have known each other four years) i am adopting his kid and they try to tell the kid all kinds of bad things about me.

as of right now they get every other weekend visits for which we drive him ALL THE TIME to there house to visit and pick him back up after the weekend. If they were to get grandparents rights can you tell me what the visitation rights are or what to do. I know they cannot get every other weekend but is there someplace i could look this stuff up. thanks

  1. there are grandparents rights in missouri

my sister left the state with a guy and my parents pursued custody of her children and were granted them, mind you though they gave my sister her kids back when she moved back to missouri and cleaned up her act

    regardless, they have rights

basically if you deny Sue rights to seeing them and she knows about the law, she can go to court and get actual visitation rights...but it'd be an actual case and you'd be able to present your information and prevent her from doing it

dont worry too much, even if she presses charges for visitation, she'd have to prove why so you'd still have a leg to stand on

  2. in the state of missouri there are no grandparents rights.  Have the boyfriend explain to them that if they can not see the child without being detrimental to her emotional well being they will not get to see her any more.  He doesn't have to let them visit with her.If you do not believe me, call a lawyer they will tell you the same thing. My uncle has cared for his granddaughter for 6 of the 8 years she has been on this earth and there is nothing the judicial system can do to ensure he gets any kind of visitation with her because Missouri has no grandparents rights laws.

  3. its sad about whats going on and did go on with the childs mother but the grandparents and child shouldnt b punished for the mistakes the mother made in her life...

heres a link about grandparents rights...hope it helps...http://www.moga.mo.gov/statutes/C400-499...

its important to read this cause it has been revised and the grandparents do have rights..
