Question:

Green Card: If application is thrown out due to undeliverable mail, can it be restarted several years later.?

My boyfriend's mom submitted I130 paperwork in 1992, somehow they let the case go and never followed through as to why they hadn't received any paperwork. So, I started to investigate to only find out that "We have destroyed the document for this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN because it was returned as undeliverable and we have not since heard from you. You must file a new application to obtain a new one. When filing a new application, follow the instructions carefully, indicate you are filing because you did not receive the last document we manufactured, and reference the receipt number for this case."

Is it possible that this can still aide the new case that we have to file? If not, wouldn't it be better if we were married and then I was to file on his behalf? Rather than his mother? He's 31. She is a citizen now, but I was born here. He would then be considered immediate family rather than 1st preferrence.

Any sound advice would be appreciated

  1. I hear they are very picky and I assumed a 1 time chance but it never hurts to try. What do you got to lose?? And yes to me it would help out alot if you sent for her instead of him when you get married, but try it. I understand totally my husband is from Mexico. Same type of situation but yet i'm very stupid when it comes to this stuff. I hope all works out and good luck.
