Green card EB5 investing?

Question

Must you invest first the whole amount then apply, or can you have a smaller company, not worth one million, which will fulfill the requirements later once the application is handed in?

Also if you have a visa which allows work through sponsorship ex. OPT or TN or CPT visa can you work in you EB5 investment place as a sponsored employee?

I am actually in the process of completing the EB5 petition for my uncle abroad.  We have chosen to make an investment through a regional center, which allows a minimum investment of 525k.   You essentially invest in a company that creates the 10 jobs required, and you simply get a % return depending on the investment you choose.  If you would like my attorneys contact info, I'd be happy to share.
