Greetings all, My Fiance in Philippines has Son 10, never married Father never see Son. I wish to adopt him?

I am marrying Filipina girl in the US,

we have applied for k-1 for her and her son to come here so we can start our lives together as a family. I totaly accept the Son as my own and would like to adopt him. The Father has no contact with Mother or child since birth and never was a marriage. He was married when he impreagnated her and left her to go to his wife. She had no idea he was married and was misslead. Would the adoption process be done here in US or in Philippines? And will there be problems? Thankyou for those who can assist us on this matter.

  1. I think you should reconsider,to many shams of people wanting green cards. Only a fool would marry a foreigner with all the news about desperate people wanting to come to America.


  2. You don't need to adopt the child before bringing him to the US. It would also involve a lot of paperwork, filing an additional petition and a lot of time and effort. Take a look at travel.state.gov and look up the adoption section and you'll get some idea of what I'm talking about.

  3. You would have to do the adoption after you have married in the US and can apply for his temporary green card at the same time. Until you  are married and have your fiance legally in the US the local courts would not have jurisdiction for the adoption proceedings.

  4. First, does she have a legitimate birth certificate for the kid?  Not a phony one, a real one where copy of it can be found at the NSO in Manila?

    I lived in the Philippines 7 years.  I understand how VERY common it is in a case like this to have a dummy birth certificate.  Your fiancee must understand that if the kid's birth certificate isn't 100% legal, with a copy on file at the NSO, she's going to be rejected and banned for life from the United States.  She must understand that she cannot submit fake papers to the US embassy.  They are EXPERTS at detecting it.

    If yes, is the father's name on the birth certificate?  If so she can't even take the kid out of the country without the father's permission.

    If no, there's no problem for her to bring the kid to the United States and for you to adopt him here, in US courts.
