Group Lotus confident about quick resolution of the case in their favour
Group Lotus clarifies its position to the media after hearing of the ‘Lotus name dispute’ this Monday. It informed the media on Tuesday that they own all the rights of the legendary team name and the court case will soon end up in their favour. It further
ruled out Team Lotus' claim that their request for a summary judgment was "thrown out" by the court.
Both the fighting parties attended the first hearing of the court trial at the London High Court this Monday. After viewing the case history, Mr. Justice Peter Smith announced that the issue was a complex one, and giving a verdict in a single meeting or
so would not be possible. For further proceeding of the case, he scheduled a full trial for March 21. While briefing the reporters regarding the case, Team Lotus said, "Team Lotus is delighted that we were successful at the summary judgment application hearing
today and that the judge threw out Group Lotus' application even before hearing the arguments of the barristers on either side."
However, Group Lotus clarified the statement saying that the judge did not "threw out" its application at all, rather it believes that its only a matter of some more time and all will be settled in their favour.
Group Lotus gave their press statement today that read, "Group Lotus and Proton have been made aware of the press release issued by 1Malaysia Racing Team (1MRT), it is completely incorrect and a misrepresentation of the judge's decision suggesting that Group
Lotus' application was "thrown out". No decision was made on Group Lotus' application. The judge proposed that the better procedural route was to order a speedy trial of all the issues in dispute in the case.”
It further stated that this date, 21 March was the earliest date available. It also said that although 1MRT was not willing to accept this date but since there was no other option they eventually agreed upon it.
The report issued by the team today assured that a quick resolution of the issue will be assured. However, the Formula One experts believe that the issue will not be solved before the mid of the season. Hence, the fans might experience the 2011 grid with
two teams and four cars, with the same name. Meanwhile, at the mid of the season one of the teams will have to switch to a new team name.
