Guardianship Help!?

I am a 16 year old Bahamian and I would like to live with my cousin who is an american citizen in Georgia, she pays taxes and has a fiance and no children.I have parents in The Bahamas but they are not financially able to educate me ,and I would also like to attend college there one day. If my parents give her Guardianship will I be able to go to public school or possibly qualify to be an american?

  1. No.  She is not an immediate relative (parent, sibling, adult child) and cannot sponsor you.  

    To do a guardianship, your parents would have to hire attorneys and petition the court to make your cousin a court-appointed legal guardian.  This cannot be done if it is for the purpose of immigration benefits (including obtaining a visa) -- it is immigration fraud.  You are already 16.  By the time this made it through the courts you would likely turn 18 and the action would be moot since you would be an adult.

    At this point, you have no possibility of coming to the US to attend school or to immigrate.  Education is much cheaper in the Bahamas than the US.  If your parents cannot afford an education in the Bahamas, they certainly cannot send you to college in the US.  To get a student visa, you must prove you have sufficient funds to pay all education expenses, plus all living costs, plus transportation back home upon completion or termination of your studies.


  2. If you want to become a citizen, the easiest way would be for your cousin to request a visa on the grounds that she is your legal guardian. She can only do this if she herself is a citizen. Going to an American high school as a non-citizen is something I have no experience in. I hope someone on this board has the info. If not ask your cousin to call the school in which you would be attending there.
