Gun control issue?????

should the gun control issue be either a federal issue or state issue (not both)? why?

i need some opinions. thanks!

  1. You have a federal constitution with federal laws that can conflict,  overlap or interact with state laws and state constitutions, regarding the possession, carrying, use, storage, transportation, labeling, licensing, and confiscation of firearms.

    There should be a balance between federal and state regulations, and the  simultaneous state and federal rights of the citizens.  For example, a state should not be allowed to make laws that are more strict than the federal regulations, if the state laws infringe on federal rights, but the federal laws should not restrict states from protecting its own citizens with reasonable gun laws.


  2. Gun control involves hitting your target on each shot.

    Gun rights are a federal issue that has been decided in favor of the actually wording of the Constitution. So just as your right to free speech was affirmed over 70 years ago, now your right to own a firearm has also been affirmed.

  4. It is a Federal Issue addressed by the Supreme Court and the Constitution. When guns are outlawed, only outlaws will be armed.

    Regulation of firearms, by its very nature, sets up a system of "haves" and "have nots," those whose lives are worth protecting, and those whose lives are not. A potential President Obama, for instance, would deny semi-automatic handguns to normal citizens, but would himself be protected by men carrying those very firearms. That may be OK for the President of the US, but the same inequality on a local level is just too much. Why should your local alderman's life be worth more than yours? And what are the implications in terms of perception when society becomes used to the difference as "just the way things are?"

  6. Both.    and a local issue.   Some areas are more dangerous than others.   But all states are part of this nation and need to act as such.

Well, the Supreme Court of the US seems to have definitively stated that the right to own firearms is an individual right, so any restrictions would probably have to come from State or Local jurisdictions, without conflicting with Federal law.  Personally I think there are more than enough laws governing firearm ownership now, and we don't need any more.  We DO need STRONG enforcement of the existing laws.

The 2nd Amendment to the US Constitution states that "The right of the PEOPLE to keep and bear arms, shall not be infringed.  Unless another amendment changes that, it is not legitimately a Federal OR a state issue.  With the exception of punishment for a crime, ALL gun control laws ARE unconstitutional.  No ruling by ANY court changes that fact.
