Guy (18 turing 19) dating girl (16 turning 17) your thoughts?

I'm not in such a relationship, just wondering what you think about it, is it even legal?

  1. The answer depends on the law in your state. Most states set the age of consent at 16, but a few like California set it at 18. In most states, there is a defence for statutory rape for teens who are close in age called the "Romeo and Juliet" defence.

    You should look up the law in your state. If the age of consent is 18 and there is no exception for teens close in age, then you should think twice before having s*x with your girlfriend.

I'm guessing you're asking about the statutory rape laws in the state.  In most states it is completely legal, but it depends on the states "Age of Consent".  Most states say that the age of consent is 16, which means a 16 yr old can have s*x with a 40 yr old if she/he wants and the age doesn't matter as long as she consents.  There are still a few states where the age of consent is 18, but there are websites where you can check for your state.

    Even if she is 16 and you are 18, most states have exceptions to statutory rape laws that state that the guy and girl must be at least 3 years apart to be prosecuted for statutory rape  i.e. 16 and 20 yr old etc.

    Look into your state's laws to be sure, but for the most part, you're safe.

  7. I'm pretty sure it's legal (I thought under 16 is where it gets illegal, but I'm no lawyer), and it doesn't seem that bad to me.  It's only a two-year difference.  My husband is 10 years older than I am--but I was 24 when we started dating.
