H1-B Visa Extension and Stamping

I am on H1-B, I am done with my visa in 2007 October. My I-94 is valid till 2009 June. Now, I am planning to visit India by 2009 Jan. If I have to come back I need to go for stamping in India. My question is, Is there any way to get VISA STAMPING staying in USA itself or Is it a mandatory to go to Home Country to get visa extension?

  1. you need to check with the attorney who did the visa for you.  This is something most people(except for the immigration attorneys) don't know much about.


  2. You don't need to go to Home Country, I know Indian contractors on H-1B that just go to the Mexican border (Brownsville) to get their H-1B stamping done. Your company's attourney should arrange all of that for you and give you the necessary paperwork (if they plan on keeping you, that is).

  3. There's no way to get a new visa while in the US. You'll have to apply at home for a new visa or perhaps in Canada. It can be possible to apply for a visa outside of your home country. Check out usembassy.state.gov for the embassy and consulate websites in India and Canada on how to get an interview appointment.
