H1B part-time?

I am woking in a firm A as full-time H1B employee. I am planning to take up a part-time job with company B after my office hours which will be completely different from my job at company A.

I know I will need H1 from company B too.

But how would the procedure work. I hope I do not have to apply with April quotas. Please help me as I am trying to figure out the procedure in obtaining part-time H1B with company B.

Also my greencard in being filed with company A under Eb2 category.

  1. i believe you'd have to file another h1 part time. company b should file this for you. you cannot have 2 jobs with one h1b. as for the april quotas, you might have a better chance since you already have an existing h1b with another employer.


  2. You are already under H1 status and yes, there is a quota. You can not legally work part time anywhere outside of your current employment. If you aren't making enough money, maybe you should ask for a raise.

  3. You are right that you would have to have an approved petition to work for the 'company b' as well. And yes I do believe it would be under the quota system. One possibility would be if you are currently under adjustment of status for the 'green card' under company A and you have an I-485 pending, you would qualify for an Employment authorization card. With the EAD card you could legally work for both companies without a petition for the 2nd.

  4. I do not think that you can do this!  You can only have one visa at a time.  Given that company A is filing your green card application, just stick with them.
