I want to transfer my H1 B to new employer(B), but my H1B is expiring in another two months. My current employer(A) has asked details from me to extend my H1B. My questions -

1) Can the new employer(B) can do a transfer and extension at same time.

2) If my current employer do H1B extension, can I transfer my H1B to another employer (B) simultaneously.

What are my options here?

  1. h1b's are renewed i believe yearly. if you want to work for another company, you must file another h1b with that new employer. h1b's are for a specific job, in a specific company. once you work for another employer, a new h1b must be filed for. you cannot have one h1b for 2 employers.

  2. Each time you want to switch employers while on H1B, you have to apply for a new H1B. It doesn't matter if you already have H1B, you can't work anywhere else but for the employer that issued it to you.

You can either work for current employer and extend your H1B or switch and apply for new H1B. Hope I helped

  3. Stay with your current employer.  If your employer thinks highly of you enough to want to extend your H1B I think you owe it to them to stay awhile longer.  I think it's a bit underhanded to go looking for another employer after you've been sponsored by your current one.
