Question:

H1B visa question?

I have a small Q. I am in US on H1-B and am getting married this year. Also my fiance is H1-B. When we travel back after marriage are there any legal documents we need to carry to prove our marriage? Or do we need to write to INS. Basically what i wanted to know how to show it on US records this change?

  1. As you are both independently in the H-1B classification and do not depend upon one another for your status, as would a H-4 spouse or child, whether you are married or single doesn't make much difference. Border officers at a port-of-entry will only care that you are still admissible as H-1B's and that you will continue to maintain that status.

    If your wife changes her last name to yours, then proof of the marriage and the name change will be important for all your identification(s) such as passport, visa, drivers license, social security card, etc.

    As for admissibility, you both need to show that you are admissible as H-1B's at the time of your application for admission, and the fact that you are now married has no effect on your admissibility.
