HELP!! I'm stuck in a Dilemma?

Here goes.. I sold my wrecked car to an autobody mechanic for one thousand dollars. He was supposed to help me find a car at a auction. He told me that he need at least $700 to bid on the car. Me being the dumb idiot I believed him. He wrote 2 receipts one for the car that I sold him & the other for locating a car for me. The receipt states that he will refund the money if the car isn't found or if I find a car elsewhere. Later that day I found a car at a local dealer and called him and told him that I needed my $$ back. Its been a month and still no money!! He eventually wrote me a check and post dated it. I deposited the check which was returned as NSF. SO I went to teh Tag and title Agency and had teh title that he had voided by ordering a duplicate. I got the police involved from day one and the same ofcr came. I wanted to reposses the car but the cop was like you already sold him the car so u cnt take it. WHAT ARE my options other than taking him 2 court?

  1. giving some one a rubber check is a felony crime. . Press charges against him. And dont let some cop tell you that you can't because you can.

    He also never paid you for the car and he cant prove that he did--another charge.

    These cries are not local matter in the sense if the local cops are just blowing you off you go to the State attourney general's office and tell them the story. This guy will either pony up or go away for a long time.


  2. The question is, did he actually buy you a car at auction?  If the answer is yes, then you don't get your money, if the answer is no, you get your money.

    Write him certified letter explaining your position, with a "copy" of the receipt he gave you, and tell him that if this matter is not corrected, you will be forced to take him to court.

  3. Go to the Police and swear out a warrent for the post dated, bad check. When he gets arrested he'll have to post bail to get out of jail. When he goes to court the judge will make him make restatution to you or go to jail for 3 yrs. Even after paying you he will still be on probation three years. People like that deserve some jail time.

  4. I would hate to tell you this but your only opions is contacting, a lawyer or taking him to court lol.

  5. What the cop was saying was that by you canceling the title on a car he paid for($1000 for the car) you committed fraud also. So it's going to end up with him getting the title back and charges can be put against you also.
