HELP! Is my car a lemon?

we bought a saturn relay in 2005 while under warranty we repeatedly since we first got it we had to have it worked on because the service theft system light was on causing the key less entry to go out. then the doors open beep would go off while driving when the doors were shut. we had it in about 8 times. could this qualify as a lemon. it's been going on since we very first got it. argh!

  1. for the correct answer to that you have to research the laws of your state and set up a meeting with an arbitrator.  but from what you are saying it is very possible that the car was broken into before you got it and they never told you. you should inform the dealer that you are considering filing a civil suit about it and see what he is willing to do to correct it.

    A manufacturer must provide a refund or replacement for a defective new vehicle when a substantial defect cannot be fixed in four attempts, a safety defect within two attempts or if the vehicle is out of service for 30 days within the first 12,000 to 18,000 miles or 12 to 24 months.

  3. You need to consult a Lemon Law attorney on this matter. Lemon Laws very by state. If you've been having this problem all of this time and it is documented, it sounds like a lemon to me. However, three years could be beyond the limit to get anything out of it- like a replacement vehicle. Consider this: the Saturn Relay has been discontinued so you might not be able to get a replacement Relay  even if they decide to replace it. Anyway, don't just listen to me, contact a Lemon Law attorney and make sure you have documents of each visit in hand. Hopefully they can do something for you. Good luck.

  4. It does sound like it is a lemon. Don't know what state you're in though. Here in California if the problems occurred while under warranty then you could pursue. If you have all the documents for the repair attempts then also good. IF the defects impair the use, safety or value of your vehicle, good again. You have given the manufacturer and/or the dealer at least 4 attempts to fix, good. I suggest getting a Lemon Law attorney.

  5. The lemon laws differ from state to state, in my state, Illinois, a lemon is considered when

    A: The problem has been there since new, been to the dealer for the same problem AND has documented proof there was a repair performed 3 times within 12,000 miles or

    B: Been at the dealer longer than 30 days (not consecutively) within 12,000 miles.  

    Once a complaint is filed and your case is justified, the dealership, at its own discretion, can perform up to 2 more repair attempts, offer to buy your car back at fair market value, or trade you for a current or 1 year older vehicle.  

    If you bought the car used, meaning you are not the first original owner, regardless of if its still under warranty or not, you have no rights under the lemon law.

    That is the same in every state!
