HELP ME PLEASE_How shall I proceed?

I will try and make this brief, On June 6 my neighbors filed a complaint against me of harrassment, I did not do it, their dogs have been killing my livestock for over a year now. called all resources available to me. no one would help. police would say shoot the dogs long story short. I went to jail for harrassment. the neighbor is a party Buddy of DA . I hired a lawyer, paid her and had 8 minutes with her. the pre-trial was 6 weeks later. I told her at the time I was not willing to do diversion I did not do anything. she never answered my calls or emails. showed up in court late today, and ran straight to da and asked for a plea deal???? , I can assure you by the look on her face today was the first day she had even read the states evidence against me, she said they had nothing but "he said she said." why didnt she try and get the charges dismissed. If I take diversion and the neighbors lie again and they will. I will go to jail. I have spoken to another lawyer and am thinking of hiring him. my lawyer I wont bother reporting to Kentucky state bar, I have already been told they wont help. shouldnt my lawyer have tried to get the charges dismissed? she didnt do anything.Honestly nothing.should I take a plea deal when I am innocent. I had to get on the internet to find out what would happen today, I have never been in a court room before. didnt know if this was the trial or what. but it was a pre-trial I found out when I went in.The one nieghbor that parties with da didnt even have to show up in court. he hates court so he didnt even come, I kept calling it to my lawyers attention, she said "while its unusual that could happen its not illegal.???? no right to face my accusers in court. also I am the same one that got arrested and was read No rights. my lawyer said they didnt have to read them. they locked me up booked me and no one even told me anything. Can good ole boy kentucky really get by with these things?

  1. I do not live in the U.S. Our laws are a little different in some areas.  But sounds like you could do a better job yourself, Than your Lawyer.  Did she even ask you if you wanted a plea deal? If you are innocent? Why would you.  Is it not Innocent until proven guilty there? Or is it Who you know?  This is So wrong,  If you are found guilty in any way. File for a mistrail and sue that Lawyer for Incompitence, That what she Is.  Did she know Your Rights were Not even given to You at arrest? That should have had everything threw out of court right there.  If this does not go your way,  Make sure you get a hold of a Newspaper and Tell them the Story.  Even If you have to Pay to have It put in the Paper. I Would rather Pay For that, And have the People of the state find out about what kind of Justice is going on,  Beings friend with a DA.  The Truth Is what you stick with And I do beleive you will previel In the Long Run...You can remember the Truth, Lies Can not be remembered.  You are Doing the right thing...Your gut it telling you this is So Wrong..Go to the Newspapers, See how fast It goes away.


  2. When you are arrested, they do not have to read you your rights unless they plan on questioning you.

    At a pre-trial conference, each side reviews what the other intends to present at trial.  Frequently, this is where plea agreements are struck.

    Because it is not a trial, witnesses do not have to come to the pre-trial conference.  If they have testimony against you, that is presented at trial.  At that time, you have the right to confront them, by cross-examination.

    To get the charges dismissed, your lawyer will have to convince the DA that there is not enough evidence to win the case.  Unfortunately, "he said, she said" is evidence enough, if the jurors believe your neighbors and don't believe you.   Dismissal doesn't sound like an option here.

    Looks like you will be going to trial.  If I were you, I'd switch lawyers and find one more interested in your case.

    BUT---beware.  If you refuse diversion (which might allow you to withdraw your guilty plea later and have the thing dismissed completely), you may be convicted at trial.  It boils down to credibility and proof.

      

  3. Dude, get another lawyer. Your lawyer did NOTHING for you!!! Stop asking US questions and go get yourself another lawyer! She didn't even answer your calls, for crying out loud! seriously, get another lawyer, TODAY. good luck

Yes the same ole same ole that I am talking about.  The lawyer runs to the DA to take a deal without properly representing you at all.  Your neighbor certainly is REQUIRED TO BE IN COURT.  IF HE ISN'T THERE THAT IS GROUNDS FOR DISMISSAL.  GET ANOTHER LAWYER IS RIGHT AND TRY TO FIND ONE OUT OF THE AREA WHERE YOU ARE OR YOU WILL GET NO JUSTICE AT ALL.
