HELP! insurance company s******g me over!!!?

i was involved in a car accident about 2 weeks ago. The other driver was at fault. She turned left in front of me while i was driving no brainer. Her insurance company contacted me the day after and told me they need a statment from her before i can get a rental car and a settlement. I have called and left messages countless times. She says they still cant get ahold of their own client...?? So now they want me to go to the police station to get the police report to fax over. Are they just stalling or what should i do???? Is there a flordia website i can go to see what they are required to do??? any help would be great. Thank you!!

  1. This may be a shock to you, but their obligations are not only to you, but also to their PAYING customer.

    Insurance companies always want to talk with their own customer, prior to initializing any settlements.

    If you can't be patient, then call your own insurance company: the one you pay money to, so they can take care of you.


  2. They need to reach their insured to confirm the details of the accident.  I am sure they are calling and leaving messages, but they are not being returned.  They are obligated to completely investigate a claim before they start shelling out money even if their insured is not cooperating.  

    You state that she took a left in front of you.  That does not mean that she was 100% at-fault for the accident.  The point of impact may place some liability on you.  

    The reason they want you to go get the police report is because they have formally requested it from the police, but they have not received it.  This can take some time.   The police will give YOU the police report.  If you want the claim to be expedited, go get it.

    If their insured does not respond within 30 days, they will likely assess liability based on your statement and the police report and consider settlement.

    It is not uncommon for a property damage claim to take 30-60 days before it is resolved especially if the insured is not cooperating.  

    If you have collision of your own, file a claim against your own policy.  The insurance company will subrogate.

  3. do what they say idiot! they can't just find their driver/policy holder at fault because you told them to... they need to speak with all drivers before they make a liability decision! think about it r****d... if you hit someone and they call your insurance and say "r****d" hit my car! do you think your insurance company is going to pay for their damage w/o talking to you?  no! they are asking you for the police report to help you! if they see it and their driver is at fault they may be able to handle your damage asap.  

    If you don’t have the patients to wait then go through your own F$$K$$G insurance company. I hate you!

  4. i would get the report and fax it to them. the sooner you jump thru there hoops the sooner you can put this behind you trying to fight them will only cost you more money and you prolly wouldn't win in court anyways sorry

  5. If you have auto insurance, let them handle this.  Them asking for a police report is normal and actually a good sign that they are not "s******g you over".  Use your insurance !

  6. Go get the police report and fax it in. UNLESS it contains information you don't want them to have,then you'd better get yourself a lawyer. Actually, your insurance company should be doing all of this for you.If you are not insured then legally you shouldn't be driving anyway and you probably don't have any rights of recovery.

    Check out that web site, it is for the insurance commissioner office for Fl.  Also you can get your insurance company involved to handle your claim, you would pay your deductible but they would then subrogate with the other insurance company to get your deductible back and anything they paid out.  But yes, her company is within its rights asking for a police report.  They cannot/will not accept fault until they have documentation of such.
